Freight Book Inc. (“FreightBook365,” “FreightBook,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal and business information entrusted to us. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use FreightBook365 websites, applications, platforms, communications, and related services including FreightBook365.com and FreightBook365Platform.com (collectively, the “Service”). By accessing or using the Service, you acknowledge the practices described in this Privacy Policy.

The information we collect depends on how you interact with FreightBook365 and whether you use the Service as a shipper, carrier, broker, agent, administrator, or other authorized user.

Some shipment information may be made available to other authorized FreightBook365 marketplace participants when necessary to facilitate freight matching, bidding, transportation, communication, or delivery.

Depending on the type of account, we may collect business information concerning carriers, brokers, and shippers.

Business contact information
Account identifiers
Carrier identifiers
Freight activity
Accepted or posted loads
Bids and offers
Transaction history
Payment status
Delivery status
Marketplace activity
User aliases or profile information

FreightBook365 may use carrier aliases or other identifiers in certain marketplace communications to limit unnecessary disclosure of a participant’s business identity.

Bids, Messages, and Communications

When you communicate through FreightBook365, we may collect and retain:

Messages
Replies
Conversation history
User aliases
Transaction-related communications

Notices exchanged between users

This information may be used to operate the marketplace, maintain transaction records, resolve disputes, prevent abuse, and provide customer support.

Payment and Banking Information

FreightBook365 facilitates certain payments, including; Credit Card, ACH transactions and electronic check payments. Payment transactions may involve third-party payment providers, including SeamlessChex and/or SafePay.

Depending on the transaction and payment method, information processed may include:

Certain financial information may be submitted directly to a payment provider rather than stored directly by FreightBook365. FreightBook365 may retain payment identifiers, transaction records, payment status, amounts, and other information necessary to administer payments, maintain accounting records, investigate disputes, and comply with legal obligations.

Identity Verification Information

FreightBook365 may use third-party identity verification services, including Plaid, to verify the identity of users or businesses.

Depending on the verification method used, identity verification may involve information such as:

Some identity information may be collected directly by Plaid or another identity verification provider. FreightBook365 may receive verification results, identifiers, status information, or other information necessary to determine whether verification has been completed.

Telephone and One-Time Password Verification

FreightBook365 may use Twilio or another communications provider to send one-time passwords (“OTP”), verification codes, account notifications, or transactional communications.

Verification codes may expire after a limited period for security purposes.

Location and Mapping Information

FreightBook365 uses mapping and routing technology, including services provided by Google Maps and or other mapping services.

Latitude and longitude

Mileage
Distance
Estimated travel information

If a device or browser feature requests access to your physical location, location information will be collected only as permitted by the applicable device or browser settings.

Google may independently process information when its mapping services are used, subject to Google’s own terms and privacy practices.

We may use service providers such as SendGrid or others to send:

Email service providers may process delivery information and related technical information necessary to deliver and secure email communications. Where applicable, users may unsubscribe from non-transactional marketing communications. Operational, transactional, legal, security, or account-related communications may still be sent when necessary to provide the Service.

We may also use aggregated or de-identified information for analytics, business planning, platform improvement, and operational purposes when the information cannot reasonably be used to identify an individual.

HOW INFORMATION IS SHARED WITH OTHER FREIGHTBOOK365 USERS

FreightBook365 operates a freight marketplace. Certain information must therefore be exchanged between users to provide the Service. Depending on the transaction and account type, information may be shared with authorized shippers, carriers, brokers, agents, or other marketplace participants.

This information may include:

Origin and destination
Shipment requirements
Pickup and delivery information
Bid information
User aliases
Company information where appropriate
Messages
Transaction information
Contact information where the applicable FreightBook365 feature permits contact
Documentation necessary to complete a shipment

FreightBook365 may limit the information displayed to particular users depending on account type, transaction status, security requirements, and platform functionality.

Users are responsible for protecting information received from other marketplace participants and using it only for legitimate freight, transportation, transaction, and business purposes.

THIRD-PARTY SERVICE PROVIDERS

We may disclose information to companies that provide services necessary to operate FreightBook365.

These providers may include:

Microsoft Azure — cloud hosting and infrastructure
Plaid — identity verification and related verification services
SeamlessChex / SafePay — ACH, banking, and payment processing
Twilio — telephone verification, OTP, and communications
Google Maps Platform — mapping, location, distance, and routing services
SendGrid — email delivery and communications
Or others

We may also use other hosting, cybersecurity, database, software-development, analytics, communications, accounting, professional, or infrastructure providers.

These service providers may receive information only as necessary to provide their services or as otherwise permitted by applicable law and their agreements with FreightBook365.

Third-party services may maintain their own privacy policies and security practices. Information provided directly to a third party may also be governed by that third party’s privacy policy.

PAYMENT INFORMATION

FreightBook365 may facilitate payments between shippers, the FreightBook365 platform, carriers, or other parties. We do not use users’ banking information for purposes unrelated to authorized payment transactions, fraud prevention, account administration, or legal compliance.

Payment providers may collect financial information directly from users.

FreightBook365 may retain information concerning a payment even when the underlying bank account credentials are processed by a third-party payment provider. This may include:

Funding-source ID
ACH transaction ID
Verification status
Carrier payment status
Shipper payment status

Users should never transmit banking credentials through ordinary FreightBook365 messaging unless expressly instructed to do so through a secure payment or verification process.

LEGAL AND SAFETY DISCLOSURES

We may preserve or disclose information when we reasonably believe doing so is necessary to:

Comply with applicable law
Respond to a subpoena, court order, warrant, or other lawful request
Cooperate with law enforcement or regulatory authorities
Protect FreightBook365, Freight Book Inc., our users, or others

We may challenge requests for information when we believe a request is invalid, excessive, or unlawful.

BUSINESS TRANSFERS

If Freight Book Inc. is involved in a merger, acquisition, restructuring, financing, sale of assets, bankruptcy, or similar corporate transaction, information associated with FreightBook365 may be transferred as part of that transaction.

Any successor receiving personal information will remain subject to applicable privacy laws and contractual obligations concerning that information.

SALE OF PERSONAL INFORMATION AND ADVERTISING

FreightBook365 is a freight transportation marketplace and does not operate its platform for the purpose of selling lists of users’ personal information to third parties.

FreightBook365 does not sell personal information for monetary consideration.

FreightBook365 also does not knowingly disclose personal information for cross-context behavioral advertising unless such practices are separately disclosed and appropriate privacy choices are provided as required by applicable law.

Information exchanged with carriers, shippers, brokers, payment processors, identity verification providers, communications providers, and other service providers as necessary to operate FreightBook365 is not intended to constitute the sale of personal information.

DATA SECURITY

FreightBook365 uses administrative, technical, and organizational safeguards designed to protect information against:

Unauthorized access
Unauthorized disclosure
Loss
Misuse
Alteration
Destruction

Access to sensitive information should be limited to personnel, contractors, and service providers who require access for legitimate business purposes.

However, no Internet-connected system, electronic transmission, or storage system can be guaranteed to be completely secure.

Users are responsible for maintaining the confidentiality of their passwords and account credentials and should immediately notify FreightBook365 if they believe their account has been compromised.

DATA RETENTION

We retain information for as long as reasonably necessary to:

Provide the Service
Maintain accounts
Complete transactions
Maintain shipment records
Maintain BOLs, invoices, agreements, and payment records
Resolve disputes
Prevent fraud
Maintain security
Comply with tax, accounting, transportation, payment, legal, and regulatory requirements

Establish or defend legal claims

Retention periods may vary depending on the type of information and the legal or business reason for retaining it.

Information may remain in backups for a limited period after deletion from active systems.

When information is no longer reasonably required, we may delete, anonymize, or securely dispose of it, subject to applicable legal requirements.

YOUR PRIVACY RIGHTS

Depending on where you reside and which privacy laws apply to FreightBook365, you may have certain rights concerning your personal information.

CHILDREN’S PRIVACY

FreightBook365 is a commercial freight transportation platform and is not intended for use by children under the age of 16.

We do not knowingly collect personal information from children under 16 through the ordinary operation of the Service.

If we learn that personal information from a child under 16 was collected improperly, we will take reasonable steps to delete it when required by applicable law.

ACCOUNT SECURITY

Users are responsible for taking reasonable steps to secure their FreightBook365 accounts.

Avoid sharing authentication codes
Use secure email and telephone accounts
Log out of shared computers
Immediately report suspicious account activity
Never provide OTP verification codes to unauthorized persons

FreightBook365 representatives will not ask users to disclose passwords through ordinary email or marketplace messaging.

FreightBook365 is operated from the United States.

If you access FreightBook365 from outside the United States, information may be transferred to, stored in, or processed in the United States or other jurisdictions where our service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from the laws in your jurisdiction.
